Accidental Death

When someone loses a loved one due to the fault of another, the surviving person may bring a wrongful death claim against the person responsible for their loved one's death. The lawsuit may be to recover medical expenses, lost wages, loss of your loved one’s help, support and company and other costs that arise from the accident.

Unlike criminal charges that might be filed by the government against the negligent person responsible for your family member's passing, a wrongful death lawsuit is filed by your attorney in a civil court to recover money damages for your loss. The standard of proof in a civil wrongful death action is different and less sringent than in a criminal prosecution. Furthermore, a civil claim does not preclude a criminal prosecution. Both actions may be brought against the wrongdoer. The difference is that in a civil action the retribution against the wrongdoer is stricktly financial.
